PRIVACY AND COOKIES POLICY

This Privacy and Cookies Policy contains information about the purposes, methods of processing, and security of your personal data as a User of the website everson.com.pl (hereinafter referred to as: the website). By reading this Privacy and Cookies Policy, you will learn who the administrator of your personal data is, what personal data is collected by the website, for what purposes it is used, and how it is protected.

§1.

Basic Information

1. The owner of the website and simultaneously the Personal Data Administrator, hereinafter referred to as the “Administrator,” is: Accurate Group Sp. z o.o. with its registered office in Toruń at ul. Wschodnia 13, KRS number 0000299241, NIP 8792547214.

§2. Definitions

1. GDPR – means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

2. Services – services provided electronically to Users within the website.

3. User – a person using the website.

§3.

Data Processing Principles

1. Personal data collected by the Administrator through the website is processed in accordance with the GDPR.

2. The Administrator takes special care to respect the privacy of Users visiting the website.

3. The Administrator processes personal data in compliance with the following principles:

a) based on a legal basis and in accordance with the law (lawfulness),

b) reliably and fairly (fairness),

c) in a transparent manner for the data subject (transparency),

d) for specific purposes and not “in advance” (purpose limitation),

e) no more than necessary (data minimization),

f) with care for the accuracy of data (accuracy),

g) no longer than necessary (storage limitation),

h) ensuring appropriate data security (integrity and confidentiality).

§4.

Purposes, Legal Bases, and Scope of Data Processing

1. We will process your data:

a) for the purpose of contact to provide a response to a User’s message sent to us via e-mail or a contact form, based on Art. 6(1)(b) and (f) of the GDPR, i.e., the realization of the Administrator’s legitimate interest related to the necessity of responding to you;

b) for the purpose of contract performance, to provide a response to a User’s message sent via email or through the contact form on the website for the performance of a contract provided electronically. Legal basis: necessity for the performance of a contract for the provision of the contact form service (Art. 6(1)(b) of the GDPR);

c) for technical purposes using cookies (technical cookies), based on Art. 6(1)(f) of the GDPR, i.e., the realization of the Administrator’s legitimate interest related to the proper operation and functioning of the website.

2. In the case of using the contact form service on the subpage https://everson.com.pl/kontakt/, the User provides the following standard personal data:

  • name,
  • their e-mail address,
  • phone number.

3. While using the website, additional information may be collected, in particular: the IP address assigned to the User’s computer or the external IP address of the Internet provider, domain name, browser type, access time, and operating system type.

4. Navigation data may also be collected from Users, including information about links and references they decide to click or other actions taken on the website. Legal basis – legitimate interest (Art. 6(1)(f) of the GDPR), consisting in facilitating the use of services provided electronically and improving the functionality of these services.

5. Other data processed by the Administrator consists of data stored in cookies. The User can decide the extent to which we can use cookies with their data. Providing data to us in this manner is voluntary. At any time, the User may change their preferences; this can be done in the web browser or by deleting stored cookies originating from the website.

6. If you like or otherwise join our social media profile (e.g., Facebook), we will process your data provided in the given medium managed by the Administrator. To cease processing, you may end the subscription to our profile.

7. External partner APIs: the website may use APIs (application programming interfaces) provided by external partners to integrate various functionalities such as maps, analytical services, advertising, or social media. Using these APIs may lead to the creation of additional cookies or the use of existing cookies to process User data. External partners may store and process this data in accordance with their own privacy policies.

8. The Administrator may collect Users’ IP addresses. An IP address is a number assigned to a User’s computer by an Internet service provider. The IP number enables access to the Internet. In most cases, it is assigned to the computer dynamically, i.e., it changes with each connection to the Internet, and for this reason, it is commonly treated as non-personally identifiable information. The IP address is used by the Administrator to diagnose technical problems with the server, create statistical analyses (e.g., determining from which regions we record the most visits), as useful information for administering and improving the website, as well as for security purposes and the possible identification of unwanted automated programs that burden the server while browsing website content.

§5.

Data Recipients, Possible Transfer of Data Outside the EEA or to International Organizations

1. The recipients of Users’ personal data are:

a) entities authorized to obtain personal data on the basis of legal provisions;

b) entities providing services to the Administrator with whom the Administrator has signed a personal data processing entrustment agreement;

2. In connection with the Administrator managing social media accounts (Facebook, YouTube), Users’ personal data is transferred to Meta Platforms Ireland Limited and may be transferred to the USA. We use Facebook’s analytical and marketing tools, such as the Facebook Pixel, to target personalized advertisements to the User on Facebook. This involves the use of cookies from Facebook. Information on the principles of data processing and the possibility for Users (natural persons) to exercise their rights under the GDPR can be found at: https://www.facebook.com/privacy/explanation. By consenting to the use of cookies on the website, the User also consents to the use of these Facebook cookies in their case.

3. Users’ personal data may be transferred to service providers used by the Administrator for operating the website. These include, among others, providers of hosting services, accounting services, marketing systems, website traffic analysis systems, and marketing campaign effectiveness analysis systems. Service providers to whom personal data is transferred, depending on contractual arrangements and circumstances, either follow the Administrator’s instructions regarding the purposes and methods of processing (processors) or independently determine the purposes and methods of processing (administrators).

4. The website uses Google Analytics tools provided by Google LLC, based at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Using cookies, they collect information regarding website visits by Users, mainly: anonymized IP addresses, visitor identifiers, subpages visited by the User, time spent on the website, transitions between individual subpages, demographic data, and interest data. Collected data is aggregated and stored on Google LLC servers in the USA. You can block Google Analytics cookie functions at any time by installing the browser add-on to block Google Analytics, found at: https://tools.google.com/dlpage/gaoptout.

5. To conduct advertising campaigns, we use Google Ads, which uses its own cookies from the aforementioned Google LLC. By consenting to the use of cookies on the website, you also consent to the use of Google Ads cookies in your case.

6. We use Google Tag Manager software, which helps us collect analytical data and control advertising campaigns and User website interactions. This tool uses its own scripts and cookies.

7. In the event of a formal request, the Administrator has the right and may be obligated to share personal data with authorized state authorities, in particular organizational units of the Prosecutor’s Office, the Police, the President of the Personal Data Protection Office, the President of the Office of Competition and Consumer Protection, or the President of the Office of Electronic Communications.

§6.

Data Processing Period

1. Personal data collected based on consent is processed until the consent is withdrawn. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

2. Users’ personal data is stored:

2.1. Where the basis for processing is consent, personal data is stored by the Administrator until the consent is revoked, and after revocation, for a period corresponding to the limitation period for claims that the Administrator may raise or that may be raised against them. Unless a specific provision states otherwise, the limitation period is 6 years, and for claims for periodic benefits and claims related to business activity – 3 years.

2.2. Where the basis for processing is the performance of a contract, the personal data of the User and/or Client is processed by the Administrator as long as it is necessary for the performance of the contract, and thereafter for a period corresponding to the limitation period for claims. Unless a specific provision states otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to business activity – 3 years.

§7.

Automated Decision-Making and Profiling

Users’ personal data is not subject to automated decision-making, including profiling.

§8.

Information about Cookies

1. Our website uses cookies.

2. Cookies are small text files stored on Users’ devices while browsing the website. They are used to facilitate website use, shorten loading times, remember User preferences, and enable analysis of traffic and User behavior.

3. Cookies can be permanent (persistent) or temporary (session). Persistent cookies are stored on the User’s device for a specified period or until deleted by the User. Temporary cookies are deleted after the browser is closed.

4. The Administrator uses different types of cookies:

a) Session cookies: information is removed from the device memory once the browser session ends or the computer is turned off. They do not allow for the collection of personal data or confidential information from Users’ computers.

b) Persistent cookies: stored in the memory of the User’s terminal device until deleted or expired. They do not allow for the collection of personal data or confidential information from the User’s computer.

c) Technical cookies: essential for the proper functioning of the website. They enable session maintenance, form handling, preference remembering, and website security. These are used by default (per Art. 173(3) of the Telecommunications Law) upon entering the website.

d) Third-party cookies: used by external analytical and advertising tools and for social media integration.

e) Analytical cookies: used to collect information on website usage, such as the number of visits, pages visited, time spent on the site, or traffic source. This data helps in site optimization.

f) Marketing / advertising cookies: allow for ad personalization and remarketing activities tailored to User interests. They also measure campaign effectiveness.

5. The cookie mechanism is safe for Users’ computers. Viruses or malicious software cannot penetrate devices via this route. Users can limit or disable cookie access; however, some site functions may require cookies to work correctly.

Why do we use cookies?

1. Cookies can significantly improve the comfort of using the website.

2. The Administrator uses cookies to display a map indicating the office location via maps.google.com (External admin: Google Inc, USA).

3. Cookies allow for the adjustment of content to User preferences and interests, making the website more attractive.

4. They can remember settings like language, layout, or color schemes for faster future access.

5. They track activity across subpages, making it easy to return to previous sections or continue unfinished actions like form filling.

6. They aid in traffic analysis for performance optimization.

7. They enable personalized advertisements, making them less invasive and more relevant.

Functions of Technical Cookies

1. Session maintenance: allowing navigation between sections without re-entering information.

2. Preference storage: language, font size, color settings, and other personalization.

3. Form handling: supporting contact forms and ensuring correct data transmission.

Functions of Analytical Cookies

Functions of Advertising Cookies

§13.

Consent for Cookie Installation

1. On the first visit, a banner informs the User about cookies. Selecting “I Accept” confirms acceptance of all cookies and acknowledgment of the purposes and possible data sharing with partners.

2. Consent is not required for essential technical cookies as they ensure uninterrupted site functioning (Art. 173(3) of the Telecommunications Law).

3. If you do not want cookies saved, select “No, thanks.” This rejects all except technically necessary cookies.

4. You can also customize choices via check-boxes on the initial banner.

§14.

User Rights

In connection with personal data processing, Users have the following rights: 1. Right to withdraw consent – Art. 7(3) GDPR.

1.1. The User has the right to withdraw any consent given at any time.

1.2. Withdrawal is effective from the moment it is made.

1.3. It does not affect the lawfulness of processing done before the withdrawal.

1.4. No negative consequences, though some functionalities requiring consent may become unavailable.

2. Right to object to data processing – Art. 21 GDPR.

2.1. The User may object at any time – for reasons related to their situation – to processing based on legitimate interest (e.g., marketing, statistics, satisfaction surveys).

2.2. Unsubscribing from marketing emails constitutes an objection to processing for those purposes.

2.3. If justified, the Administrator will cease processing and delete the data unless other legal grounds exist.

3. Right to erasure (“right to be forgotten”) – Art. 17 GDPR.

3.1. Right to demand deletion of some or all data.

3.2. Applicable if data is no longer necessary, consent was withdrawn, an objection was raised, or processing was unlawful.

3.3. Certain data (name, email) may be retained to the extent necessary for establishing, pursuing, or defending claims.

4. Right to restriction of processing – Art. 18 GDPR.

4.1. The User may demand a halt to processing while a request is being considered.

4.2. Applicable if accuracy is contested, processing is unlawful but deletion is not desired, data is needed for claims, or an objection is pending verification.

5. Right of access to data – Art. 15 GDPR.

5.1. Right to confirm if data is processed and to obtain access, information on purposes, categories, recipients, and storage periods.

5.1.3. Right to a copy of personal data.

6. Right to rectification – Art. 16 GDPR.

6.1. Right to correct inaccurate or incomplete data.

7. Right to data portability – Art. 20 GDPR.

7.1. Right to receive data in a machine-readable format (e.g., CSV) and send it to another administrator.

7.2. Requests are fulfilled or refused within one month (extendable by two months for complex cases).

8. Complaints and queries regarding processing can be sent to the Administrator.

9. Right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).
